This Thursday, October 14, 2021 at 9:00 a.m. ET, Attorney Cameron Atkinson will once again stand before a three-judge panel at the United States Court of Appeals for the Second Circuit to argue for the rights to New York healthcare workers. Although we gained a victory when a temporary restraining order was upheld by the court on September 30, 2021, that is only in place temporarily until the court can issue a ruling on our motion for a preliminary injunction after this Thursday’s hearing. If we prevail on Thursday, the injunction will remain in place until the court issues a final ruling on the merits of our lawsuit to protect New York’s frontline heroes.
This means that the State of New York would be prohibited from enforcing its unconstitutional regulation for the duration of the litigation.

Why is this Oct. 14 case more important than the Oct. 12 one where Federal Judge Hurd sided with the healthcare workers, ordering the religious exemption to stay in place? Can the outcome of the Oct. 14 case undermine the Oct. 12 success?

The case in front of Judge Hurd is good.
But the Oct 14th case is in the SECOND CIRCUIT Court of APPEALS – One step away from the Supreme Court.
This case is poised to win, and set a very good precedent – although nothing is ever certain in court.
IF this case on Thursday is ultimately victorious, as it appears it will be, it will set a very good precedent for KANE vs DE BLASIO to follow and may give us a new direction forward.

Yes you are right.
It was postponed because NY State decided to appeal in the LOWER COURT.
Ultimately, according to my attorney Sujata Gibson, the courts decided to COMBINE the two current Healthcare worker cases, and hear them argued concurrently. Many attorneys and experts that I speak with think this is ultimately a good thing.
However, only time will tell.
I will try to post a full update on the website to this very soon.

No. This case is about HEALTH CARE WORKERS. Rachel Maniscalco’s case is for NYC Educators. Different cases, both linked to the Religious Exemption
