*Update – Clearly there were issues today with children not being allowed into school buildings. Ultimately our case ***IS NOT*** going to get all students and teachers back into their school buildings. We never challenged the entire testing program, we only challenged issues surrounding student and teacher privacy rights. Our case was never designed to get everyone back to in-person education without signing the consent form for in-school COVID testing: another lawsuit from other parties and attorneys will be announced very soon in that regard. I will have updated information this evening, 12-16-20.

I spoke to our attorney Michael Sussman this morning.
ANY TEACHER OR STUDENT BARRED FROM NYC PUBLIC SCHOOLS TODAY FOR NOT SUBMITTING A SIGNED IN-SCHOOL COVID TESTING CONSENT FORM MUST LET MYSELF OR MR. SUSSMAN KNOW IMMEDIATELY.
When I told Mike this was happening he said, “The judge will not be pleased,” and asked us to inform him of everyone’s experience today.
My kids were not permitted to enter the school building today. I was told “a Twitter post” is not legal documentation and that the school policies on this have not changed.

My children were barred from school because we did not consent to the testing. They were then transitioned to a full remote schedule.
