FOIA Request Placed for Excelsior Pass Vaccine Passport

John Gilmore is Executive Director of the Autism Action Network and Children’s Health Defense NY Chapter. He is also one of TEACHERS FOR CHOICE Labor & Legal advisors. Last month he wrote a Freedom of Information request sent to the “Records Access Officer” at records.access@exec.ny.gov regarding the new Excelsior Pass announced by Governor Cuomo in partnership with IBM.

So far there is no public knowledge of how an individual’s data on Excelsior Pass is shared with IBM or any other private company. One of the locations that is utilizing this new vaccine passport is Barclays Center in Brooklyn, NY. That is a public venue. What are the legal implications here?

This is very similar to TEACHERS FOR CHOICE issue with NYC DOE in-school COVID testing and Fulgent Genetics: we will not know, for sure, what all the implications are until all of the contracts and agreements surrounding this new public-private partnership with Excelsior Pass are released. – mk

We are requesting under the New York Freedom of Information Law any contracts, agreements, or correspondence, including letters and emails, concerning “Excelsior Pass” or any other system of vaccine or testing verification, between the New York Governor’s office and International Business Machines (IBM), subsidiaries or contractors of IBM, and Madison Square Garden and its affiliated organizations; Barclays Center, Empire State Development Authority, and the Brooklyn Arena Local Development Corporation; and the County of Albany, New York and the Times Union Center.

Please email the following records if possible. If for any reason any portion of my request is denied, please inform me of the reasons for the denial in writing and provide the name, address and email address of the person or entity to whom an appeal should be directed.
