After all but one plaintiff in KANE vs DE BLASIO were denied their requests for religious exemptions to vaccination by the City of New York – for the third time – attorney Sujata Gibson has filed an emergency appeal to the 2nd Circuit Court.
This is the second time the case has appealed to the 2nd Circuit. The first appeal was successful, where ultimately the 2nd Circuit Court overturned the ruling from Judge Caproni in the lower court, and opened a door to justice that allowed plaintiffs to reapply for religious exemptions to vaccination. Now Gibson is asking the 2nd Circuit to overturn the lower court’s decision yet again.
It’s anyone’s guess what will happen in the 2nd Circuit on this second appeal. If relief is not found in the 2nd Circuit it is possible the case will appeal to SCOTUS.
