Open Letter to the New York State Bar Association (NYSBA) from New York Teachers For Choice (NYTFC)
The following letter was sent to every email contact we could find of the New York State Bar Association (NYSBA) regarding their recent recommendation that every New Yorker should be force injected with the coming COVID vaccine. To NYSBA:
On behalf of New York Teachers For Choice (NYTFC) I write this letter to express our profound disappointment and utter disbelief that you have recommended every New Yorker should be forced to inject an as-of-yet unidentified biologic product known as “the COVID vaccine.”
There are currently over 100 experimental COVID vaccines in trials, and we don’t know which one, if any, will be safe and effective for use on the population. We also don’t know how many doses of the vaccine will be recommended. It is astonishing that your organization has no problem recommending an experimental product be forced on every adult and child in New York even though you don’t know which product will be forced on us or how many times it will be forced on us. Is it one experimental vaccine per lifetime that will be forced on us? Or will it be one experimental vaccine per year forced on us? Two experimental vaccines per year forced on us?
By any definition, the coming COVID vaccine will be experimental when deployed.
The COVID vaccine experiments are going through a “warp speed” process that bypasses standard safety testing and protocols to come to market in under 2 years time. This is one of the fastest vaccine approval processes in history. One obvious piece of safety we will not have is what long term adverse effects the COVID vaccine will have on those injected with it and what percentage of subjects are likely to experience such adverse reactions. This has all the makings of the horrendous “swine flu” vaccine debacle rushed to market under President Ford which injured and killed thousands in the late 1970s largely because it came to market too quickly.
Your recommendation is in violation of the Nuremberg Code.
It is truly, deeply sad to see prominent attorneys such as yourselves violating one of the highest achievements of your colleagues from the past, as the Nuremberg Code was penned by American attorneys. As I am sure you are aware the Nuremberg Code was written at the end of World War 2 after Nazi concentration camps and human experimentation were uncovered. It states:
“The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved, as to enable him to make an understanding and enlightened decision.”
Your legal opinion so clearly violates the Nuremberg Code in so many regards it would take a minimum of 2,000 additional words to detail such transgressions.
You also claim that “the authority of the state to respond to a public health crisis is well-established in constitutional law,” and there is some truth to this. However the COVID vaccines in experimental trials right now are not being tested to stop the spread of SARS CoV-2, but rather merely to lessen the symptoms of those who contract the virus. Dr. Fauci himself has recently stated this fact. So by forcing the COVID vaccine on people, you will not be helping to stop the spread of the virus at all. Clearly, this is not a necessary intervention addressing the public health crisis in front of us. It’s equivalent to forcing people to take Tylenol for a common cold. It makes even less sense when realizing COVID has a death rate of under 1%. But of course, this all makes perfect sense to the Big Pharmaceutical interests who are situated to make billions in profits from your Draconian legal rationale.
The NYSBA recommendation to force the COVID vaccine on all New Yorkers regardless of religious or philosophical objection, and regardless of the fact that any COVID vaccine will by definition be an experimental medical intervention, is an abomination of legal thinking and argument which will not age well in the annals of history. We know our words here only mean so much to you as we do not represent the powerful interests it seems you do in fact represent; we are merely teachers and educators. You should note that we currently have over 5,400 signatures on our petition which is against any forced vaccine mandates for educators. You can view that petition at the following link:
