POSTPONED! Teachers for Choice Lawsuit

Attorney Sujata Gibson Backed by Children’s Health Defense

***NEW DATE – JULY 18, 12 noon***

Rally at 11am

  • Were you fired by NYC DOE for declining covid vaccination?
  • Were you forced into early retirement, or forced to quit?
  • Did you try at some point to get religious exemption?
  • You don’t have a lawyer? You don’t have a lawsuit?
  • Then YOU need to come to the court on July 18!

Richmond Supreme Court

26 Central Avenue

Staten Island, NY 10301

DiCapua v. City of New York is now scheduled to be in NY State Supreme Court in Staten Island on July 18 at 12 noon. TEACHERS FOR CHOICE is a named plaintiff in the case which is backed by Children’s Health Defense.

The rescheduled date will be announced soon. It will be a very exciting day because attorney Sujata Gibson will be seeking class certification – this means officially defining an impacted class that can apply to be part of the case. So if you were an educator in NYC, or NYC DOE employee, fired for declining the covid shot and you do not a lawyer representing you, THIS DAY IS VERY IMPORTANT FOR YOU AND YOU NEED TO SHOW UP TO COURT!

Now to be clear, just because you SHOW UP at this court date DOES NOT MEAN you automatically become part of the lawsuit. But we need hundreds of people to be there to show the judge how many people have been impacted, and to show the court that the public is watching this case!

Up until now, several proposed class action lawsuits have been filed, but this is the first time that oral arguments will be heard to formally attempt to certify a class. If the Judge certifies a class, all DOE employees who were denied religious accommodation to the COVID-19 vaccine mandate could potentially become members of this lawsuit. If you are able to come and show your support, please do. Attorney Gibson asks that everyone makes sure to be quiet and peaceful in the courtroom, so that the Judge can hear arguments without distraction.

We need a HUGE SHOWING on JULY 18!!!

  1. Hi Mike,

    <

div>Does this also apply to those who resigned or retired under duress?

  2. Does this apply to teachers that were denied a religious exemption that chose to resign? Or is it just those that were fired.

  3. I did not apply for a religious exemption. Just didn’t want to take the shot. I also do not have a lawyer representing me but have a claim number and had a zoom hearing with a DoE attorney. I will be there on July 18th.

  4. I was pregnant at the time and fired for not taking the vaccine. I applied for a religious exemption, was denied, appealed denied again. I then reapplied for the exemption when the court had said you could reapply, denied again. I have since moved to Georgia as I could no longer afford to live in New York without a job. I am unable to attend the hearing in person. Will there be a live feed so that I can join? I support all that you are doing. Thank you. I would like to join your lawsuit if you succeed during this hearing.
