The case DiCapua v. City of New York backed by Children’s Health Defense is seeking to certify the first class action lawsuit for any NYC DOE employee who was fired or displaced in anyway from their job for declining covid vaccination. Our attorneys are asking that this class include anyone who requested a religious exemption to vaccination at any point up until January of 2023.

Attorneys Mary Holland and Sujata Gibson will be speaking at a rally in front of the courthouse at 10:30 am along with Michael Kane who, along with Teachers for Choice, is a named plaintiff in the case.

Important note on attire: Judge Porzio made it crystal clear no one is to wear shorts in his courtroom on August 14. Suits, ties, dresses are not required. I asked out attorneys if t-shirts with messages on them were acceptable to wear in court (Teachers for Choice, Bravest for Choice, “Think while it’s still legal” etc…). Feel free to wear such t-shirts if you so choose, our attorneys feel it is certainly appropriate.

But absolutely no shorts, the judge made that very clear.

  2. Is it only for those who put in for a religious exemotion?What about just my constitutional rights to choose not to get a vaccine if it wasnt medically needed? I had antibodies and didn’t need it.I didn’t put in for a religious exemption because I heard they weren’t accepting them.

    1. Our case only applies to NYC DOE employees who applied for a religious exemption at some point in time. There are other lawsuits that are dealing with individuals illegally fired for declining covid vaccination
